Welcome to Nurneys. These Terms of Service (the "Terms") govern your access to and use of the website nurneys.com (the "Site") and any purchase you make from us. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

4. Orders and Order Acceptance

When you place an order, you are making an offer to purchase the products listed at the prices displayed at the time of checkout. We reserve the right to accept or decline your order, in whole or in part, at our sole discretion.

Reasons for declining an order include, but are not limited to:

  • Product unavailability;
  • Errors in product or pricing information;
  • Suspected fraudulent or unauthorized activity;
  • Shipping address outside the United States;
  • Failure to meet our eligibility requirements.

An order confirmation email is not an acceptance of your order. Acceptance occurs only when the order has been shipped. If we decline your order after payment, you will receive a full refund.

5. Order Cancellations

If you need to cancel an order, please contact us as soon as possible at info@nurneys.com. We can usually cancel an order if it has not yet entered processing. Once the order has been processed or shipped, it cannot be cancelled, and you will need to follow the return process described in our Refund Policy after delivery.

6. Pricing and Payment

All prices on the Site are displayed in U.S. Dollars (USD). Prices may change at any time without notice, but changes will not affect orders that have already been confirmed.

We accept the following payment methods: Visa, Mastercard, American Express, Apple Pay, and Google Pay. Payment is processed at the time you place your order. Your card will be charged immediately.

You are responsible for any applicable sales tax, which is calculated at checkout based on your shipping address.

If your payment fails or is declined, your order will not be processed. We are not responsible for any bank or card-issuer fees you may incur.

7. Promotional Codes and Discounts

From time to time, we may offer promotional codes, discounts, or special offers. These are subject to the following conditions:

  • Each code may only be used once per customer, unless stated otherwise;
  • Codes cannot be combined with other offers, unless stated otherwise;
  • Codes cannot be applied retroactively to orders already placed;
  • We reserve the right to cancel or modify any promotion at any time, in case of suspected abuse or system error.

8. Shipping

We ship exclusively within the United States. Shipping costs, processing times, delivery estimates, and other shipping-related terms are detailed in our Shipping Policy.

9. Returns and Refunds

You have 30 days from the date of delivery to request a return on eligible items. Returns are subject to the conditions set out in our Refund Policy, which you are encouraged to review carefully before making a purchase.

If your order arrives damaged, defective, or incorrect, please contact us at info@nurneys.com within 7 days of delivery with your order number and clear photos of the issue. We will arrange a replacement or a full refund and cover all return shipping costs.

Refunds are processed within 5 to 10 business days after we receive and inspect the returned item, and credited to the original payment method used at checkout.

10. Product Information and Availability

We make every reasonable effort to display accurate product information, including descriptions, specifications, dimensions, materials, and images. However, slight variations in color, texture, or appearance may occur due to screen settings, lighting conditions, or manufacturer updates.

All products are subject to availability. We reserve the right to discontinue any product at any time without notice. If a product becomes unavailable after you place an order, we will notify you and issue a full refund for that item.

11. User Conduct

When using the Site, you agree not to:

  • Use the Site for any unlawful, fraudulent, or harmful purpose;
  • Attempt to gain unauthorized access to any part of the Site, our servers, or any related systems;

To the fullest extent permitted by applicable law, Nurneys disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Nurneys be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Site or any product purchased from us.

Our total liability for any claim arising out of these Terms or your purchase shall not exceed the amount you paid to Nurneys for the product giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of these limitations may not apply to you.

16. Indemnification

You agree to indemnify, defend, and hold harmless Nurneys and its officers, employees, agents, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any applicable law or third-party rights.

17. Force Majeure

Nurneys shall not be liable for any failure or delay in performing its obligations under these Terms caused by events beyond its reasonable control, including but not limited to natural disasters, severe weather, acts of war or terrorism, pandemics, government actions, labor disputes, supplier or courier failures, cyber-attacks, or interruptions of internet or power services.

18. Governing Law

These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of laws principles.

19. Dispute Resolution and Arbitration

Most concerns can be resolved quickly and to your satisfaction by contacting our customer service team at info@nurneys.com. We encourage you to reach out before initiating any formal proceedings.

If a dispute cannot be resolved informally, you and Nurneys agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or any product purchased from us shall be resolved by binding individual arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

The arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in the State of Delaware, in the English language. The arbitrator's decision shall be final and binding.

20. Class Action Waiver

YOU AND NURNEYS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Unless both you and Nurneys agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding.

21. Modifications to These Terms

Nurneys reserves the right to modify these Terms at any time. Changes will become effective upon posting to this page. The "Last updated" date at the top of this document indicates the date of the most recent revision.

Your continued use of the Site after any change constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

22. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable, and all remaining provisions shall continue in full force.

23. Entire Agreement

These Terms, together with our Legal Notice, Privacy Policy, Shipping Policy, Refund Policy, and Contact Information, constitute the entire agreement between you and Nurneys with respect to your use of the Site and supersede any prior agreements.
